These are the terms and conditions of Midoricha. They apply to every order you place through midoricha.com. Please read them carefully before you order. Any questions? Email us at support@midoricha.com.

Article 1. Definitions
In these terms and conditions, the following terms have these meanings:
- Midoricha (also "we" or "us"): the trader named in Article 2, who sells ceremonial matcha to consumers through the web shop midoricha.com.
- You: the consumer. A natural person who is not acting for purposes relating to a trade, business or profession.
- Distance contract: the sales contract concluded through the web shop, without you and us being physically present at the same time.
- Subscription: the recurring delivery through Subscribe & Save, as described in Article 6.
- Withdrawal period: the period of 14 days during which you can exercise the right of withdrawal.
- Right of withdrawal: your legal right to cancel the purchase within the withdrawal period.
- Business day: Monday to Friday, excluding Dutch public holidays.

Article 3. Applicability
These terms and conditions apply to every offer from Midoricha and to every distance contract between Midoricha and you. Before you complete an order, you can read these terms and conditions on this page. You can easily save or print the text.
Deviations from these terms and conditions only apply if we have agreed them with you in writing. If any provision of these terms and conditions is invalid, the remaining provisions continue to apply. We will then replace the invalid provision with a valid provision that matches its intent as closely as possible.
We may amend these terms and conditions. The version that was in force at the time you placed your order applies to that order. If we change the terms and conditions in a way that is unfavourable to your active subscription, we will inform you in advance. You may then cancel your subscription free of charge before the change takes effect, even if you have not yet received 2 deliveries.
Article 4. The offer and prices
We sell ceremonial matcha in a sealed package of 30 grams. The price is EUR 29.90 for a one-time purchase. With a subscription you pay EUR 26.90 per delivery, a discount of 10%.
All prices are in euros and include VAT. Shipping costs are not included and are shown separately at checkout. Article 9 explains which shipping costs apply.
We describe our products as completely and accurately as possible. Obvious mistakes or errors in the offer, for example a clearly incorrect price, do not bind us.
Price changes do not apply to orders that have already been placed. If we change the price of your subscription, we will let you know by email before the new price takes effect. If you do not agree with a price increase, you may cancel your subscription free of charge before the new price takes effect, even if you have not yet received 2 deliveries.
Article 5. Formation of the contract
The contract is concluded when you complete your order and we confirm receipt by email. As long as we have not confirmed the order, you can cancel the contract free of charge.
We may refuse an order or attach additional conditions to it if there is a good reason to do so, for example a delivery address outside our delivery area. If we refuse an order, we will let you know as soon as possible and immediately refund any amount already paid.
Article 6. Subscription (Subscribe & Save)
With a subscription you automatically receive a new delivery of matcha at the interval you choose: every 14, 30, 45 or 60 days. You pay EUR 26.90 per delivery instead of EUR 29.90.
The following conditions apply to the subscription:
- The subscription runs for a minimum of 2 deliveries.
- If you withdraw from the contract within the legal withdrawal period of 14 days after receiving the first delivery (Article 11), the entire subscription ends and the minimum of 2 deliveries does not apply.
- After the second delivery you can cancel at any time through your customer account. There is no notice period.
- A cancellation applies to all deliveries that have not yet been processed. If a delivery has already been processed, it will still be shipped and charged.
- The amount per delivery is automatically charged through the payment method you chose when taking out the subscription.
Within a subscription you also have the rights set out in Article 11 and Article 12 for every delivery.
Article 7. Payment
You pay during the ordering process through Shopify Payments. You can choose from iDEAL, Bancontact, credit card, Apple Pay, Google Pay, Klarna and Shop Pay, among others. You can see exactly which payment methods are available at checkout.
If you give us incorrect payment details, or if your details are no longer correct, please report this immediately via support@midoricha.com.
Article 8. Personal data
We process your personal data to carry out your order and your subscription, for example for your customer account, the payment and the delivery. How we do this and which rights you have is explained in our privacy policy.
Article 9. Delivery and delivery area
We deliver to addresses in the member states of the European Union and in Switzerland, Norway and Iceland. We do not sell or ship to the United States or the United Kingdom.
If you order from Switzerland, Norway or Iceland, local VAT, import duties or customs clearance fees may apply on import. These costs are for your account and are collected by the carrier on delivery.
Shipping costs:
- Netherlands, Germany and Belgium: free shipping.
- Ireland: EUR 9.95, free from an order value of EUR 99.95.
- Other countries in our delivery area: EUR 4.95, free from an order value of EUR 49.95.
Delivery times:
- Netherlands, Belgium and Luxembourg: ordered on a business day before 15:00, delivered the next business day.
- Rest of Europe: 2 to 4 business days.
- Ireland: 3 to 6 business days.
We ship with DHL eCommerce. As soon as your package is on its way, you automatically receive a Track & Trace code by email. If you place a pre-order, we ship your order as soon as all products in the order are in stock. For a pre-order we state the expected shipping date on the product page and in the order confirmation.
If we do not deliver within the agreed period, you can give us a reasonable additional period. If we still do not deliver within that additional period, you may cancel the contract. We will then refund the full amount paid as soon as possible.
The risk of damage to or loss of products lies with us until the moment of delivery to you or to a recipient you have designated.
Article 10. Retention of title
Delivered products remain the property of Midoricha until you have paid the full purchase amount. This is particularly relevant if you choose a payment method where you pay afterwards.
Article 11. Right of withdrawal
You have a withdrawal period of 14 days. It starts on the day after you, or a recipient designated by you, received the product. For a subscription, the withdrawal period starts on receipt of the first delivery. Within the withdrawal period you may cancel the purchase without giving any reason.
Important exception: matcha is a foodstuff in sealed packaging that is not suitable for return for health and hygiene reasons once the seal has been broken (Article 6:230p of the Dutch Civil Code). An opened or unsealed bag of matcha is therefore excluded from the right of withdrawal. If the seal is still intact, you can withdraw as normal.
How withdrawal works:
- Within the withdrawal period, notify us via support@midoricha.com that you want to withdraw from the purchase. You may use the model withdrawal form that you can find on the page Right of withdrawal, but this is not required.
- Return the product within 14 days of your notification to the return address in Article 2. You pay the costs of the return shipment yourself.
- We will refund the purchase amount, including the standard shipping costs of the original shipment. We will do this within 14 days after we have received the return, or after you have shown that you have shipped the package. You will receive the refund through the same payment method you used to pay.
If you withdraw within the withdrawal period after the first delivery of a subscription, the entire subscription ends.

Article 12. Conformity and warranty
You are entitled to a product that conforms to the contract: the legal guarantee of conformity. We do not offer any additional commercial warranties.
Did you receive a product that is defective, damaged or not the product you ordered? Email us at support@midoricha.com. We will send a replacement product at our expense, or we will refund the purchase amount. This does not affect your other legal rights.
Article 13. Complaints
Are you dissatisfied with something? Email your complaint with your order number and a clear description to support@midoricha.com. We will respond as quickly as possible, and at the latest within 14 days of receiving your complaint. If handling takes longer, we will let you know within those 14 days when you can expect a substantive response.
If we cannot resolve the matter together, you can submit the dispute to the competent court. Article 15 explains which court that is.
Article 14. Liability
We are liable in accordance with the law. Nothing in these terms and conditions limits your mandatory rights as a consumer, or our liability for damage caused by intent or deliberate recklessness, or any other liability that cannot be excluded or limited by law.
To the extent permitted by law, our liability is limited to the amount you paid for the order in question. This limitation does not apply to damage resulting from death or personal injury, to product liability, or to intent or deliberate recklessness.
Store and prepare the product according to the instructions on the packaging.
Article 15. Applicable law and competent court
Contracts between Midoricha and you are governed by Dutch law. If you live in another country within our delivery area, you also retain the protection of the mandatory consumer law of the country where you live.
Disputes are submitted to the court that has jurisdiction by law. If you live outside the Netherlands, this may be the court of your own place of residence.
This document is a translation of the Dutch version. In case of any differences, the Dutch version prevails.
